Service by Publication or Divorce by Publication is when a spouse of defendant cannot be found in the State of New Jersey and a Judge permits service by publication instead of regular service. Before a judge allows for substituted service you must prove that the Defendant cannot be found. This needs to be done through the postmaster general, department of elections, department of motor vehicles to name a few. Upon making a motion to accept substituted service, the judge will review the paperwork and decide if it is acceptable. If it is found to be acceptable that a diligent inquiry has been done, a legal publication must be placed in the local newspaper serving the defendant. From that point he or she has 35 days to respond. Failure to respond within 35 days will lead to a default where the Judge will enter a judgment of divorce after you or your attorney enters the proper paperwork proving he has defaulted.
